By using Aivency (the "Service"), you agree to these Terms. Please read them carefully.
1. The Service
Aivency provides AI-generated competitive intelligence reports based on public information about competitors you choose to track. Reports are decision-support tools, not professional advice.
2. Account
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 and authorized to act for the company you represent.
3. Subscription and billing
- Paid plans (Professional, Growth) are billed monthly via Stripe.
- Subscriptions renew automatically until canceled.
- You can cancel anytime from your customer portal; access continues until the end of the paid period.
- Fees are non-refundable except where required by law.
- Professional plan is limited to one on-demand report per 7 days; Growth includes daily reports.
4. Acceptable use
You agree not to: (a) reverse engineer the Service, (b) use it to violate laws or third-party rights, (c) submit content you don't have the right to provide, (d) use it to harass, defame, or run unlawful surveillance, (e) circumvent rate limits or plan restrictions.
5. Your content and data
You retain ownership of the content you submit. You grant us a limited license to process it solely to operate the Service. We process public competitor data to generate insights; you are responsible for ensuring your monitoring complies with applicable laws.
6. AI-generated content
Reports and chat responses are produced by AI and may contain errors or omissions. You are responsible for verifying insights before acting on them. Aivency is not liable for business decisions made based on the Service.
7. Intellectual property
The Service, including software, design, and trademarks, is owned by Aivency. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription.
8. Termination
We may suspend or terminate your account for breach of these Terms or for non-payment. You may terminate at any time by deleting your account.
9. Disclaimer
The Service is provided "as is" without warranties of any kind. We do not warrant that reports are accurate, complete, or fit for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by law, Aivency's total liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Changes to the Terms
We may update these Terms. Material changes will be communicated by email or in-product. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws applicable at our principal place of business, without regard to conflicts of law principles.
